Anti-Spam Policy

Email Transmit has a strict no-spam policy. To protect the rights of the email recipients, Email Transmit will not allow the sending of unsolicited email (spam). Violators of this policy will have their account privileges suspended and will be liable to the penalties outlined in this policy. To register a complaint or suspicion of anti-spam violations, please notify Email Transmit at abuse@emailtransmit.com

Following the rules of proper email marketing, every email sent via Email Transmit will contain an unsubscribe link. This functionality cannot be turned off or removed.

Definition of Spam

Spam is any unsolicited email. Spam is also known as junk mail or UCE (Unsolicited Commercial Email.) Any promotion, information or solicitation that is sent to a person via e-mail without their prior consent is Spam.

Email Transmit Anti-Spam Policy Violations

Sending or relaying UCE or SPAM emails is prohibited by any of the following:

  1. Any person or company who is a customer of and otherwise has permission to send or receive email as a normal consequence of obtaining services from Email Transmit or any authorized resellers thereof.
  2. Any person, employed by, related to or otherwise provided with access to a customers email account.
  3. Any person who is not a customer of Email Transmit and who uses any means whatsoever to originate or relay any UCE / SPAM or any other email to any person, company or email address.

Any person or entity who violates this policy, by so doing, agrees that...

  1. If they are a customer of Email Transmit or any person acting on behalf of a customer, shall subject that violator, upon first complaint, to disconnection of email privileges for that account for up to 90 days. Upon second complaint, shall be subject to termination of all services, with balance of account for remainder of agreement due and payable in full upon cancellation.
  2. If offender is not a customer, their use of Mass Transmit's servers shall be prosecuted to the fullest extent of the law as a criminal trespass, theft of bandwidth, and denial of service.
  3. Any person or entity, by sending or relaying any email via any of our servers, shall agree to pay to Mass Transmit the sum of $100.00 for the first email plus $10.00 per additional email relayed or sent in addition to costs associated with investigation, prosecution and collections of said amount.
  4. any person or entity using any means to misrepresent or alter the "reply to", ê"from" fields, headers, message ids, ip addresses, or any other portion of any email including information contained in the body of said message which would indicate that such email has been relayed by or sent from our servers, by so doing, shall agree to pay to mass transmit the sums indicated in (c) above, whether said email was, in fact, relayed via any server under the control of mass transmit as a fee for use of our name.
  5. Any person or entity as described in (d) above shall also be considered to have illegally used our trade name in a manner inconsistent with approved use of such names and in such a manner as to cause harm to the good name and reputation of Mass Transmit. Such person or entity shall, thereby, be subject to civil and criminal liabilities to the fullest extent of the law for such infringement libel or slander.
  6. Any person or entity who acts or knowingly fails to act in such manner that facilitates any of the above, by so doing, agrees to be liable as if that party was the actual violator.
  7. Any ISP, or other carrier of internet services who directly provides email services to any violator as outlined above and who, upon reasonable and sufficient proof and notice, refuses or fails to take any action to halt such emails or continues to permit such email activity shall, by such action or inaction, become equally liable along with any such violator, and thereby, agrees to the same liabilities outlined above, notwithstanding any other provisions of law. Such notice shall serve to remove any presumption of ignorance on the part of said ISP or carrier and to inform same as to the provisions of this policy.

How to protect yourself from Spam

Take the Spam Test:

  1. Are you importing a purchased list of ANY kind?
  2. Are you sending to non-specific addresses such as: * sales@domain.com, business@domain.com, webmaster@domain.com, info@domain.com, or other general addresses?
  3. Are you sending to distribution lists or mailing lists which send indirectly to a variety of email addresses?
  4. Are you mailing to anyone who has not explicitly agreed to join your mailing list?
  5. Have you falsified your originating address or transmission path information?
  6. Have you used a third party email address or domain name without their permission?
  7. Does your email's subject line contain false or misleading information?
